It is “the province and duty of the judicial department to say what the law is.”

—Chief Justice John Marshall in Marbury v. Madison (1803)

Legislative Day

In congressional usage, a legislative day extends from the time either chamber of Congress meets after an ADJOURNMENT until the time it next adjourns. The rules in each chamber call for certain routine business at the beginning of each legislative day. (See MORNING HOUR.)

The House normally adjourns at the end of a daily session, so its legislative days usually correspond to calendar days. The Senate, however, frequently goes days and sometimes weeks or even months without an adjournment; instead, it recesses. By recessing, it continues the same legislative day and avoids interrupting unfinished business.
